Terms & Conditions of Sale
These Terms govern the sale by Newman Business Solutions Limited to you of Products for which you place an order that is accepted by us. Note that our catalogues and websites are intended for business users only, and we reserve the right to refuse service and cancel orders to non-business customers. No other terms and conditions shall apply. Your acceptance of the Products shall be deemed to constitute acceptance of these Terms.
2. Orders and prices
You can order anytime at http://supplies.newmanbs.co.uk or by phone on 01892 664155. Our lines are open Monday to Friday 9.00am to 5.15pm.
If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you upon discovery of the error to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. Should we have fulfilled the order before discovering the error, we reserve the right to take back the goods and refund you the purchase price or charge you the correct amount.
3. Standard Delivery Policy and Delivery Charges
Subject to stock availability we aim to deliver all orders within 1-2 working days provided orders are received before 4.30 pm and we have stock. Please note that paper and a few special furniture products may require a slightly longer delivery time and you will be informed by e-mail of the alternative delivery date. Our standard delivery charge is £6.99 plus vat for orders up to the value of £74.99 plus vat. Orders over £75.00 plus vat will not be charged for delivery. Please note if you are ordering outside of the UK additional carriage charges may apply and you should contact us for a quotation.
4. Back Orders
Any item that is out of stock when ordered will be placed on backorder; you will be notified by e-mail of the expected delivery date.
Should we receive no response from our e-mail we will assume that you wish to accept the goods on the date as specified.
If the delivery date is unacceptable please respond to our e-mail and we will cancel the backorder and either credit your credit card or, if you are an account customer, you will not be invoiced.
5. Damaged, Missing or Faulty Items
If any items are damaged or missing from your order, please contact us within 24 hours of your delivery on 01892 664155 or email firstname.lastname@example.org. We will then investigate your claim and if acceptable, either directly replace the item or issue a credit. We will pay the return shipping costs if the product is defective or the return is a result of our error.
Returned goods must be unused, in a saleable condition and in their original packaging

6. Payment and Title
Unless you are a Newman Business Solutions Limited Credit Account Holder, you must pay for the Products at the time you place your order. If you are an account holder, please be aware that under the terms of the Late Payment of Commercial Debts (Interest) Act 1998, we are entitled to levy interest and a late payment compensation fee on overdue debts. Credit accounts are not available for first time orders. If paying by credit card on an order and you require the goods to be delivered to an alternate address other than that which your credit card is registered to, we may need to verify your details before we can process your order. Newman Business Solutions Limited reserves the right, by giving you notice at the time you place your order, to increase the price of the Products to reflect any increase in the cost to Newman Business Solutions Limited which is due to any factor beyond its control. Title to the goods will not pass until payment has been received in full.
7. Damaged, Missing or Faulty Items

All products purchased through Newman Business Solutions Limited benefit from the manufacturer’s warranty or guarantee, if any. Legally, this clause only applies to business customers. Please note that the use of an electric screwdriver for the assembly of chairs will void your guarantee.
Nothing in these Terms shall exclude or limit Newman Business Solutions Limited liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law. Without prejudice to the previous sentence, Newman Business Solutions Limited shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of Newman Business Solutions Limited, its breach or non-performance or any of its obligations under these Terms or otherwise. These Terms set out the full extent of Newman Business Solutions Limited obligations and liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any other kind whatsoever, that are binding on Newman Business Solutions Limited except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If you are a consumer the exclusion of terms implied by law will not apply to you.
Newman Business Solutions Limited shall not be liable to you for any loss or damage which you might suffer arising from Newman Business Solutions Limited delay in fulfilling or failure to fulfil any of its obligations under these Terms to the extent that such delay or failure is caused by any circumstance beyond Newman Business Solutions Limited reasonable control. If due to such circumstances or events Newman Business Solutions Limited has insufficient stocks to meet all its orders, Newman Business Solutions Limited may apportion available stocks between its customers at its sole discretion. These Terms and any terms appearing on any order form to which these Terms apply constitute the entire agreement between you and Newman Business Solutions Limited relating to the Products. The failure of Newman Business Solutions Limited or you to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or unenforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions. No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by an authorised representative of Newman Business Solutions Limited. Newman Business Solutions Limited may transfer any contract with you concluded on these Terms or any of its rights or obligations under any such contract. These Terms will be construed in accordance with the laws of England and any disputes shall be settled by the English courts.
11. Defined Terms
"Newman Business Solutions Limited" means Newman Business Solutions Limited Ltd, whose head office is at Newman House, Farningham Road, Crowborough, East Sussex TN6 2JR. "Terms" means these terms and conditions of sale. "Products" means any products listed in this catalogue for which you place an order which is accepted by Newman Business Solutions Limited. "You" means you, the customer.
